Thanks for your interest in StratPack! Please read these Terms of Service (“Agreement”, “Terms of Service”, “Terms”) carefully before using our services operated by Map & Fire, LLC (“M&F”, “StratPack”, “us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of StratPack’s Product (https://app.getstratpack.com) and Site (https://getstratpack.com), and includes the use of the StratPack API and the use of the StratPack API by third party integrations authorized via your StratPack account.
By accessing our Product or Site you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing our Product and Site. The materials and services contained in our Product and Site are protected by applicable copyright and trademark law.
The services StratPack offers are for your own use only. You do not have permission to resell, lease, or provide the services in any other way to anyone else outside of any specific permission granted via our Product or Site.
Intellectual Property and Ownership
The Site and its original content, features and functionality are owned by Map & Fire, LLC and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. Content provided by a user is the property of that user. StratPack has rights to that property only to the limited extent granted in these Terms. Your user content is your responsibility. StratPack has no liability for it, or for any loss or damage your user content may cause to you or others. You may not attempt to decompile or reverse engineer any software contained in our Product or Site, or “mirror” the materials on any other server.
Disclaimer
- The materials and services provided in our Product and Site are provided on an ‘as is’ basis. StratPack makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
- Although we take great measures to insure the reliability and security of our Product and Site, no software is perfectly secure or reliable. There are always risks when using any Internet service and you agree to accept these risks when using our Product or Site. StratPack does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials in our Product or Site or otherwise relating to such materials or on any sites linked to our Product or Site.
Limitations
In no event shall StratPack or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials or services on our Product or Site, even if StratPack or an StratPack authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
We claim the right to use your provided content to the extent necessary to operate and provide the services of our Product and Site. You agree your content does not violate these Terms and will not violate the rights of or injure any person or entity. Content owned by StratPack may not be modified, reproduced, or distributed except as permitted in these Terms.
Privacy Policy
StratPack takes your privacy and security very seriously. Please refer to our Privacy Policy for more information about StratPack’s collection and use of your personal data. Using our Product or Site is an agreement of the Privacy Policy.
Registration
You are responsible for the accuracy of any information you provide when signing up for our Product. You are responsible to maintain the security of your password and login information and accept all risks of unauthorized access to your account. You are responsible for all activity on your account and for all charges incurred by your account.
Fees
Fees for use of our Product are described in the Product and on our Site. Fees may at times change, but StratPack will give you notice before any changes. Your continued use of the Product after fee changes indicates your agreement with the new fees after the effective date of change.
Accuracy of Materials
Although we make every effort to make sure our materials and services are 100% accurate, it is possible our Product or Site could include technical, typographical, or photographic errors. StratPack does not warrant that any of the materials or services in our Product or Site are 100% accurate, complete, or current. StratPack may make changes to the materials contained in our Product or Site at any time without notice. However StratPack does not make any commitment to update the materials.
Links and Integrations
StratPack has not reviewed all of the third party sites linked to from our Product or Site and is not responsible for the content of any such linked site. The inclusion of any link does not imply endorsement by StratPack of the site. Use of any such linked website is at the user’s own risk.
StratPack might also make available third party integrations to our Product that are not owned or controlled by StratPack. StratPack has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party integrations or services. We strongly advise you to read the terms of service and privacy policy of any third-party service that you visit or integrate with.
Governing Law
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of the State of California, United States, without giving effect to any principles of conflicts of law.
Termination
We may terminate your access to the Product, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. It is your responsibility for maintaining records, copies, etc. of your content.
Modifications
StratPack may revise this Agreement for its Product or Site at any time without notice. By using our services you are agreeing to be bound by the then current version of these terms of service.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Product or Site, or discontinue any use of the Product or Site immediately.
